Kathryn Erbe has her own major case now.
A 36-year-old man accused of trying to get uncomfortably close to the former Law & Order: Criminal Intent star has been charged with interstate stalking, a federal crime.
According to FBI investigators, Charles Nagel, a husband and father of two from Philadelphia, traveled to New York with his family multiple times in 2008 and 2009 to visit the L&O set, one time getting Erbe to pose for a picture with him and his daughter.
Nagel then, according to the Feds, tried to chase after Erbe as she was being driven away from the set. Another time, he allegedly showed up at the show's production office looking for her.
Then, per investigators, he reached out to Erbe's daughter on MySpace, writing that he was "not some dangerous stalker," but rather a "harmless romantic who wrote songs over her."
He also allegedly set up a Facebook account under the name "Cindy Momberger" and posted the picture he had with his daughter and Erbe, cropping the girl out so it looked as if it was just him and the actress.
Shortly before he was arrested on March 24, Nagel sent Erbe's kid a message containing a photo of her with a cockroack hand-drawn over her face and a thought bubble reading, "I'm ugly," next to it.
Nagel has been jailed in lieu of $50,000 bail since his arrest for alleged stalking. An extradition hearing was scheduled for today but was canceled after Brooklyn prosecutors tacked on the federal charge.
Nagel's attorney, Robert F. Datner, has said that his client's actions were harmless and that he only approached Erbe during public L&O shoots.
According to the Philadephia Inquirer, Nagel was sentenced to 19 years' probation in 1996 after he pleaded guilty to corrupting a minor, false imprisonment, simple assault, reckless endangerment, making terroristic threats, indecent assault and unlawful restraint for attacking a 15-year-old girl.
Erbe, along with costar Vincent D'Onofrio, left Law & Order: Criminal Intent this past spring after eight seasons.
